Under U.S. immigration laws, individuals and families that are currently facing persecution or fear that they will be persecuted in their home countries on the basis of race, religion, nationality, political ideology, or membership in certain social groups can seek asylum in the United States. Applying for Asylum in the U.S.

In order to be granted asylum, you must apply within one year of entering the United States. There is no fee for applying, but the process can be complicated and confusing. You will need to make sure you have all the proper documents and paperwork, both for yourself and any eligible family members you may have with you.

To apply for asylum in the United States, you will need to:

  • Show that you are eligible for asylum on the basis of actual or feared persecution in your home country
  • Complete and file the Form I-589, Application for Asylum and for Withholding of Removal within one year of entering the U.S.

If your application for asylum is successful, you may petition to bring your spouse and unmarried children under the age of 21 to the U.S. as well. To do so, you will need to complete and file the Form I-730, Refugee/Asylee Relative Petition within two years (in most cases).

New Laws Regarding Refugees

United States Citizenship and Immigration Services (USCIS) is currently tightening laws regarding refugees. By law, the term “refugee” applies only to individuals outside of the United States who have not yet resettled in another country and have faced actual or feared persecution in their home country based on certain characteristics/ideologies. Additionally, the U.S. must take a humanitarian concern in the individual in order for him/her to be considered a refugee.

The processes and procedures involved in obtaining asylum and/or refugee status have become more complex and, in many cases, more limiting under the current administration.
