Understanding the Naturalization Process

As previously mentioned, naturalization is the most common process of obtaining U.S. citizenship. This is the primary way in which an immigrant can apply to become a citizen of the United States. To do so, however, you must first meet certain requirements.

To be eligible for naturalization, you must:

  • Be at least 18 years of age
  • Continuously live in the U.S. for a period of 5 years (or 3 years if married to and living with a legal U.S. citizen) prior to being admitted as a lawful permanent resident
  • Physically be in the U.S. for at least 30 months of the 5 years (or 18 months of the 3 years if married to a U.S. citizen) immediately prior to filing the application for naturalization
  • Be able to demonstrate your “good moral character” during the last 5 years (or 3 if married to a U.S. citizen)
  • Show your ability to read, write, and speak English
  • Pass an examination on United States history and civics

With some very rare exceptions, you must meet all of these requirements in order to be eligible for naturalization in the United States. Additionally, certain criminal acts may prevent an individual from being eligible for naturalization; if you have been accused of or convicted of a criminal offense, speak to an attorney about your legal options.

Derivative & Acquired Citizenship

Under U.S. immigration laws, certain individuals may already be U.S. citizens and not realize it. If you were born abroad to a parent or parents who were U.S. citizens at the time of your birth or lived in the U.S. as a lawful permanent resident and were under the age of 18 when one or both or your parents obtained citizenship through naturalization, you are already a U.S. citizen. This is known as derivative/acquired citizenship.

In order to obtain your citizenship certificate, you will need to follow a certain process with the Department of Homeland Security. Your citizenship certificate will allow you to obtain a U.S. passport and prove that you are a legal citizen of the United States.
