The Deportation/Removal Process

The deportation/removal process begins when an individual is deemed “inadmissible” to the U.S. In some cases, the individual may be detained by ICE but in most instances, the Department of Homeland Security (DHS) will send the individual a Notice to Appear (NTA). This begins the formal process, including court proceedings to determine if the individual is indeed inadmissible and, therefore, able to be deported from the U.S. After receiving the NTA, the individual must attend U.S. immigration court proceedings where an immigration judge will make a ruling. If the individual is ruled inadmissible, he or she may appeal this finding with the Board of Immigration Appeals.
